Disclosure Statement Regarding the Law on the Protection of Personal Data No. 6698 and the Rights Under This Law

This Disclosure Statement on the Processing and Protection of Personal Data ("Disclosure Statement") has been prepared by AZUR COSMETIC to fulfill our obligation to inform you, the data subjects, within the scope of the Law on the Protection of Personal Data No. 6698 ("PDPL"). This Disclosure Statement explains the procedures our company must follow in the processing of your personal data and your rights and freedoms regarding the protection of your personal data.

1. What is the Legal Basis for Processing Personal Data and for What Purposes is it Processed?

In accordance with Articles 4, 5, and 6 of the PDPL No. 6698, your personal data may be processed within the framework of the instructions and applications you provide, obligations arising from legal regulations, and within these legal boundaries. Personal data are processed for purposes such as enabling you to benefit seamlessly from the services provided, fulfilling obligations arising from contracts, informing you regarding the service you purchase, notifying you about campaigns, and complying with obligations related to information storage, reporting, and informing.

Personal and special categories of personal data such as identity information, contact information, legal compliance information, request and complaint management data, visual and audio data, customer data, and customer transaction data may be collected, recorded, stored, updated, classified, shared with or transferred to third parties within the scope permitted by the legislation, all under the concept of “Data Processing” as defined under the PDPL.

Your personal data may be processed to:

  • Complete transactions verbally or electronically,

  • Plan and implement corporate sustainability, corporate governance, strategic planning, and information security processes,

  • Fulfill administrative and legal obligations,

  • Communicate regarding products and services purchased or to be purchased,

  • Engage in marketing activities if consented to,

  • Offer products/services, conduct modeling, reporting, scoring, risk monitoring, and intelligence activities,

  • Identify potential customers and conduct market studies related to capital market activities.

Collected personal data may also be processed by our Company and Affiliates to ensure that you benefit from the products and services offered, customize services according to your preferences and usage habits, ensure legal and commercial security of individuals related to our company, and plan and execute our commercial and business strategies as well as human resources policies, within the personal data processing conditions and purposes set forth in Articles 5 and 6 of the PDPL.

2. To Whom and For What Purposes the Processed Personal Data May Be Transferred

Your collected personal data may be shared with our Company’s domestic and international direct or indirect shareholders, affiliates, parent companies, group companies, program partners, third parties involved in co-branding, individuals and institutions authorized by law, and other third parties providing services domestically or internationally. This transfer will be in accordance with the principles established under the relevant data protection legislation.

3. What are the Rights of the Personal Data Owner under Article 11 of the PDPL?

Under the PDPL, as a data subject, you have the right to:

  • Learn whether your personal data has been processed,

  • Request information if your personal data has been processed,

  • Learn the purpose of processing and whether it is used in accordance with its purpose,

  • Know the third parties to whom your personal data is transferred domestically or abroad,

  • Request correction if your personal data is incomplete or incorrectly processed,

  • Request deletion or destruction of your personal data,

  • Request notification of the correction, deletion, or destruction to third parties to whom personal data has been transferred,

  • Object to any outcome against you arising from the analysis of your personal data exclusively through automated systems,

  • Request compensation for damages in case of unlawful processing of your personal data.

In order to exercise your rights, your application must:

  • Clearly state the right you wish to exercise,

  • Concern your own data or if acting on behalf of someone else, be supported by a special authorization and documentation,

  • Include your identity and address information,

  • Be accompanied by documents proving your identity.

You may submit your request by filling out the application form available on our website and sending a signed copy along with identity-verifying documents to our address in person, via notary, or via other methods specified in the PDPL. Alternatively, you may send it to info@azurcosmetic.com with a secure electronic signature.

We will finalize your request as soon as possible and within thirty (30) days at the latest, depending on the nature of the request. If the process incurs an additional cost, a fee will be charged in accordance with the tariff determined by the Personal Data Protection Board.

4. For How Long Will the Data Be Stored?

Your personal data will be processed and stored solely for the purposes notified to you under this Disclosure Statement and will be retained for the legally mandated retention periods. After these periods, your personal data will be deleted, destroyed, or anonymized either automatically or upon your request, pursuant to Article 7 of the PDPL.
