ARTICLE 2 - SUBJECT

The subject of this Agreement is the sale and delivery of the product, which the BUYER has electronically ordered from the Seller’s website (estebiencosmetic.com), as detailed below, and the determination of the parties' rights and obligations under the provisions of Law No. 4077 on the Protection of Consumers and the Regulation on the Implementation of Distance Contracts.

ARTICLE 4 - GENERAL PROVISIONS

4.1 - The BUYER acknowledges and declares that they have read the essential characteristics, specifications, VAT-inclusive sales price, payment method, and delivery terms of the product(s) on the SELLER’s website and that they approve the purchase electronically.

4.2 - The product(s) will be delivered to the recipient at the address specified by the BUYER, within the delivery period specified on the website, depending on the distance between the BUYER’s address and the SELLER. The SELLER is not responsible if the recipient at the address does not accept or refuses the delivery.

4.3 - The SELLER is responsible for delivering the product(s) without any defects and in accordance with the agreed specifications.

4.4 - The product(s) will not be delivered unless a signed copy of this Agreement is received by the SELLER and the price has been paid via the payment method chosen by the BUYER. In electronic contracts, the confirmation process is also carried out electronically. If the payment for the product(s) is not made or the payment instruction is canceled by the bank for any reason, the SELLER’s obligation to deliver the product(s) is void.

4.5 - If the BUYER’s credit card is used fraudulently by unauthorized individuals and the bank or financial institution does not pay the SELLER for the product, the BUYER must return the product to the SELLER within 3 days of the delivery date at their own expense.

4.6 - If the SELLER cannot deliver the product due to force majeure or extraordinary situations like adverse weather conditions or transportation disruptions, they must inform the BUYER. In such cases, the BUYER can cancel the order, accept a substitute product, or delay the delivery until the situation is resolved. If the order is canceled, the amount paid will be refunded to the BUYER within 10 days.

4.7 - This agreement becomes effective once the BUYER confirms it electronically.


ARTICLE 5 - RIGHT OF WITHDRAWAL

Products with defects that do not meet the standards or specifications, or have a significant shortcoming in terms of their intended purpose, can be returned. The BUYER can request a refund, exchange the defective product, or a discount on the price within 14 days from the delivery date.

For distance sales contracts, the BUYER has the right to withdraw from the contract within 7 days of receiving the product, without any legal or penal liability, and without providing a reason.


ARTICLE 6 - PRODUCTS WHERE THE RIGHT OF WITHDRAWAL CANNOT BE USED

The right of withdrawal does not apply to products that are custom-made or specially prepared for the BUYER, single-use products, software and programs, items that deteriorate quickly, or products that have passed their expiration date. For the following items, the right of withdrawal can only be used if the packaging has not been opened, the product is undamaged, and unused:

  • Software and programs

  • DVDs, VCDs, CDs, and cassettes

  • Office supplies (toner, cartridges, etc.)

  • Cosmetic products

  • Personalized items


ARTICLE 7 - COMPETENT COURT

In case of disputes arising from this agreement, the Consumer Arbitration Committees and Consumer Courts of the BUYER’s or SELLER’s domicile, within the monetary limits announced by the Ministry of Industry and Trade, are authorized.


ARTICLE 8 - EXCLUDED CONTRACTS

This regulation does not apply to contracts related to:

  • Bank, insurance agreements

  • Vending machine agreements

  • Public telephone agreements

  • Auctions

  • Regularly delivered goods such as food, beverages, or daily necessities

  • Contracts involving accommodation, transportation, catering, sports, cultural activities, or entertainment services that are to be supplied on specific dates.


Enforcement

  • This regulation came into effect on 14.06.2003.

  • The Minister of Industry and Trade is responsible for enforcing this regulation.

By confirming the order, the BUYER accepts all terms of this Agreement.
